This Notice sets out the Listing and Registry arrangements for Bankruptcy Matters within the Sydney Registry of the Federal Circuit Court from September 2012.

Applications for Substituted Service

Listing of Petitions and Bankruptcy Notice Applications 

Most petitions will be listed in the Registrars' Bankruptcy List at Queens Square. Applications to set aside bankruptcy notices will generally be listed in the Registrar's Tuesday List at 11.30am.

Listing of Opposed Petitions & Applications

Where a Notice Stating Grounds of Opposition has been filed, the proceedings may be adjourned to the Registrar's Monday List (at the JMT Building) with directions given and a timetable laid down for the conduct of the petition and proceedings.

Applications to review a Registrar's decision and applications that are outside the power of a Registrar will generally be listed in the Registrar's Monday List at 10am (at the JMT Building).

There is a Bankruptcy Judge who is available to accept referrals from the Registrar's Monday List.

Substituted Service Applications

Substituted service applications will continue to be listed and dealt with by a Registrar in eCourt at (nominally) 4pm on the day listed in the filed application.

Urgent Bankruptcy Applications

Parties with urgent applications relating to bankruptcy that cannot wait until the next Monday List must approach the Duty Registrar in the Registry at Level 17 Law Courts Building Queens Square, initially by phone on 9230 8567, who will make appropriate arrangements.

REGISTRY ARRANGEMENTS

Documents in bankruptcy matters (eg creditor’s petitions, applications and any other documents) will continue to be filed:

  1. In the Registry at Level 17 Law Courts Building,  Queens Square Sydney (between 9am and 4.30pm)
  2. By eLodgement through www.fmc.gov.au (after registering)
  3. By fax filing to 9230 8295

Parties and practitioners are encouraged to commence any bankruptcy matter electronically through eLodgment.

Listing & Adjournment Information

Parties and practitioners must ensure the listing and return information on creditor’s petitions, applications and any adjournment notifications record the correct location for the day upon which a matter is listed. Please check the court list so that practitioners and parties attend the right location.
